§ 1 Geltungsbereich
§ 1 Scope
Diese Allgemeinen Geschäftsbedingungen gelten für alle Verträge zwischen der Vivodepot GmbH, Körnerstraße 7–10, 10785 Berlin (nachfolgend „Vivodepot") und Verbrauchern sowie Unternehmern über den Kauf von USB-Sticks über den Onlineshop vivodepot.de. Vivodepot Privat ist daneben kostenlos und ohne Registrierung über vivodepot.de erhältlich; dafür kommt kein Kaufvertrag zustande, und diese AGB gelten insoweit nicht.
These Terms and Conditions apply to all contracts between Vivodepot GmbH, Körnerstraße 7–10, 10785 Berlin (“Vivodepot”) and consumers or businesses for the purchase of USB sticks through the online shop at vivodepot.de. Vivodepot Private is also available free of charge and without registration via vivodepot.de; no purchase contract is concluded for it, and these Terms and Conditions do not apply to it.
Abweichende Bedingungen des Käufers werden nicht anerkannt, es sei denn, Vivodepot stimmt ihrer Geltung ausdrücklich schriftlich zu.
Deviating terms of the buyer are not recognised unless Vivodepot expressly agrees to their validity in writing.
§ 2 Vertragsschluss
§ 2 Conclusion of contract
Die Darstellung der Produkte im Onlineshop stellt kein rechtlich bindendes Angebot dar, sondern eine Aufforderung zur Bestellung. Mit der Bestellung gibt der Käufer ein verbindliches Angebot ab. Die Annahme erfolgt durch Versand einer Auftragsbestätigung per E-Mail oder durch Lieferung der Ware.
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order. By placing an order, the buyer makes a binding offer. The offer is accepted by sending an order confirmation by e-mail or by delivering the goods.
§ 3 Preise und Zahlung
§ 3 Prices and payment
Alle Preise verstehen sich in Euro und enthalten die gesetzliche Mehrwertsteuer. Der Kaufpreis für den Vivodepot USB-Stick beträgt EUR 49,00 (einmalig, kein Abo). Versandkosten werden gesondert ausgewiesen.
All prices are in euros and include statutory VAT. The purchase price of the Vivodepot USB stick is EUR 49.00 (one-off payment, no subscription). Shipping costs are shown separately.
Die Zahlung erfolgt über die im Shop angebotenen Zahlungsmethoden (Kreditkarte, weitere Optionen gemäß Anzeige im Bestellprozess).
Payment is made using the payment methods offered in the shop (credit card, other options as shown during checkout).
§ 4 Lieferung
§ 4 Delivery
Die Lieferung erfolgt innerhalb Deutschlands per Post. Die Lieferzeit beträgt in der Regel 3–7 Werktage nach Zahlungseingang. Vivodepot haftet nicht für Verzögerungen durch den Versanddienstleister.
Delivery within Germany is by post. Delivery normally takes 3–7 working days after receipt of payment. Vivodepot is not liable for delays caused by the shipping company.
Eine Lieferung ins Ausland ist auf Anfrage möglich (info@vivodepot.de).
Delivery abroad is available on request (info@vivodepot.de).
Vivodepot ist nicht Herstellerin im Sinne des Elektro- und Elektronikgerätegesetzes (ElektroG). Als Vertreiberin gibt Vivodepot die WEEE-Registrierungsnummer des Lieferanten an: DE 31310269 (SanDisk / Western Digital).
Vivodepot is not a manufacturer within the meaning of the German Electrical and Electronic Equipment Act (ElektroG). As a distributor, Vivodepot states the supplier’s WEEE registration number: DE 31310269 (SanDisk / Western Digital).
§ 5 Widerrufsrecht
§ 5 Right of withdrawal
Verbrauchern steht ein gesetzliches Widerrufsrecht zu. Die Widerrufsfrist beträgt 14 Tage ab dem Tag, an dem der Käufer oder ein von ihm benannter Dritter die Ware in Besitz genommen hat.
Consumers have a statutory right of withdrawal. The withdrawal period is 14 days from the day on which the buyer, or a third party named by the buyer, takes possession of the goods.
Um das Widerrufsrecht auszuüben, genügt eine eindeutige Erklärung per E-Mail an info@vivodepot.de. Die Kosten der Rücksendung trägt der Käufer.
To exercise the right of withdrawal, a clear statement by e-mail to info@vivodepot.de is sufficient. The buyer bears the cost of returning the goods.
§ 6 Eigentumsvorbehalt
§ 6 Retention of title
Die gelieferte Ware bleibt bis zur vollständigen Bezahlung Eigentum von Vivodepot.
The goods delivered remain the property of Vivodepot until paid for in full.
§ 7 Gewährleistung
§ 7 Warranty
Es gelten die gesetzlichen Gewährleistungsrechte. Bei Mängeln hat der Käufer zunächst Anspruch auf Nacherfüllung (Reparatur oder Ersatzlieferung). Schlägt die Nacherfüllung fehl, kann der Käufer vom Vertrag zurücktreten oder den Kaufpreis mindern.
The statutory warranty rights apply. In the event of defects, the buyer is initially entitled to subsequent performance (repair or replacement). If subsequent performance fails, the buyer may rescind the contract or reduce the purchase price.
§ 8 Haftungsbeschränkung
§ 8 Limitation of liability
Vivodepot haftet unbeschränkt für Vorsatz und grobe Fahrlässigkeit sowie für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit.
Vivodepot is liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health.
Im Übrigen haftet Vivodepot nur bei Verletzung einer wesentlichen Vertragspflicht, und zwar auf den vorhersehbaren, vertragstypischen Schaden begrenzt. Eine weitergehende Haftung ist ausgeschlossen. Die Haftung nach dem Produkthaftungsgesetz sowie bei Übernahme einer Garantie bleibt hiervon unberührt.
In all other cases, Vivodepot is liable only for breach of a material contractual obligation, and then limited to the foreseeable damage typical for this type of contract. Any further liability is excluded. Liability under the German Product Liability Act and liability arising from the assumption of a guarantee remain unaffected.

Die Vivodepot-Software ist ein Werkzeug zur persönlichen Datenverwaltung. Sie ist kein Medizinprodukt im Sinne der EU-Medizinprodukteverordnung (MDR, Verordnung (EU) 2017/745) und erbringt keine medizinische Diagnostik, Therapieempfehlung oder klinische Entscheidungsunterstützung. Gesundheitliche Entscheidungen sind ausschließlich in Abstimmung mit qualifizierten medizinischen Fachkräften zu treffen.
The Vivodepot software is a tool for managing personal data. It is not a medical device within the meaning of the EU Medical Device Regulation (MDR, Regulation (EU) 2017/745) and does not provide medical diagnosis, treatment recommendations or clinical decision support. Health decisions must be made only in consultation with qualified medical professionals.
§ 9 Lizenz und Nutzungsrechte
§ 9 Licence and rights of use
Die auf dem USB-Stick enthaltene Vivodepot-Software steht unter der European Union Public Licence 1.2 (EUPL-1.2). Der Quellcode ist öffentlich zugänglich unter github.com/vivodepot/vivodepot(öffnet in neuem Fenster)(opens in a new window). Die Lizenz gestattet die private und kommerzielle Nutzung, Weitergabe und Modifikation unter den Bedingungen der EUPL-1.2.
The Vivodepot software on the USB stick is licensed under the European Union Public Licence 1.2 (EUPL-1.2). The source code is publicly available at github.com/vivodepot/vivodepot(öffnet in neuem Fenster)(opens in a new window). The licence permits private and commercial use, distribution and modification under the terms of the EUPL-1.2.
§ 10 Streitbeilegung
§ 10 Dispute resolution
Vivodepot ist nicht bereit und nicht verpflichtet, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
Vivodepot is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
§ 11 Anwendbares Recht und Gerichtsstand
§ 11 Applicable law and place of jurisdiction
Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts. Gerichtsstand für Kaufleute und Personen ohne allgemeinen Gerichtsstand in Deutschland ist Berlin.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for merchants and for persons without a general place of jurisdiction in Germany is Berlin.
